Congress Passes Defense Bill Codifying Indefinite Detention


The President is expected to sign the bill, which will allow indefinite detentions without charge or trial, even for American citizens

The Senate passed the 2012 defense authorization bill 86-13 on Thursday, one day after the House of Representatives passed it in a 283-136 vote. The bill, which codifies a system of indefinite detention for terrorism suspects, will be sent to the President’s desk today.

The Obama administration is supportive of the bill and is expected to sign it into law, despite initially threatening to veto it on the grounds that those provisions “mandat[ing] military custody” amounted to a “restriction of the President’s authority” to choose what to do with terrorism suspects. No mention of the disintegration of the fifth amendment’s due process clause appeared in the administration’s objection.

In response to this veto threat, the Senate revised the provisions mandating military custody and inserted the option of a waiver for American citizens; that is, the Executive branch would be allowed to waive the requirement to deprive suspects of their constitutional rights at their discretion.

As revealed in the Senate deliberations last week, the Obama administration itself requested the principal authors of the provision – John McCain and Carl Levin – to include language authorizing due-process-free military custody for American citizens. The initial threat of veto was apparently nothing more than political theater on the part of the White House.

While the provision’s language is threatening to the due process rights of the accused – whether U.S. citizen or not – the bill would really only codify into law already existing practice for depriving accused terrorists of due process.

“If President Obama signs this bill,” said Laura W. Murphy, director of the ACLU Washington Legislative Office, ”it will damage both his legacy and America’s reputation for upholding the rule of law. The last time Congress passed indefinite detention legislation was during the McCarthy era and President Truman had the courage to veto that bill. We hope that the president will consider the long view of history before codifying indefinite detention without charge or trial.”

    Thank you Mark, for posting this report.

    I have, in a number of comments, explained the Jew as the consummate “Legalist”; and, have evidently set forth that, “whenever the Jew is about to embark on some heinous activity, it will first ‘legalize’ it’s actions”

    This was true in EVERY instance; whether in abortion, anti-christian legislation, genocidal war, etc.et al.

    There is no doubt that the persecution of Americans has now become ‘Legal’ for them. It will happen and the sister initiative of extrajudicial execution will be implemented in conjunction with it.

    I think “seriously” ! that folks had better get out their “Book of Revelation”, and begin to recognize who and what is being scripted in it’s presentation.

    I would add, for those who doubt that the ‘Revelation Script’ is being fulfilled; then, what else could be taking place ?

    The Gaza Strip is coming to a neighborhood near you. We’re all Palestinians now. All those Christians who had no problem with Muslims being tortured will be singing a different tune when it’s happening to them. Injustice anywhere is a threat to justice everywhere.

    i’m worried about the americans but feel that once it really starts to bite they will erupt. hopefully the military [except the higher officers who are probably in cahoots ??] will do the right thing and turn on the NWO assholes. so in the end nobody deliberately did anything except these jewish banksters. notice folks the winds are gathering? the clouds a little darker? yes read your revelations; as evidently these evil cretins never have. the world neednt end at all; or not right now. but they wont listen…

    You took the words write out of my mouth. People should have been protesting when George Bush said it would be a war that would last hundreds of years and called it a crusade. Americans should have protested when Bush said they would disregard international laws, the rules of war, and trash the constitution but no one gave a damn. They should have been protesting about war crimes when Muslims were being abducted,tortured,raped and murdered but nobody cared. This is what happens when you support a monstrous system that causes injustice and misery overseas. The monster turns on it’s own supporters just like the Soviet Union under Josef Stalin in which his most enthusiastic supporters ended up in the Gulags or received a bullet to the back of the head. Now it’s turning around to bite Americans in the ass. To put it simply it’s the chickens coming home to roost. Welcome to the world of Muslims Christian America. Now it’s your turn.

    @Lindsey:True , there are tons of good people out there who know the truth, even if they are a minority it is still very encouraging.
