CANADA – Arthur Topham convicted of ‘promoting hatred against Jews’, loses constitutional appeal

CBC NEWS – A B.C. man convicted of wilfully promoting hatred against people of the Jewish religion has lost a constitutional fight over the same issue in court.

Arthur Topham’s lawyer argued in B.C. Supreme Court in Quesnel that his client’s communication on his website was justified in a free and democratic society and that in this Internet age, the same viewpoints are available in many places.

The Crown noted that the arguments were based on an erroneous assumption that Topham only republished material written by others on his website — which wasn’t the evidence put before the jury during his trial in November.

In a decision posted Monday, Justice Bruce Butler says that fact that the Internet has increased people’s ability to communicate widely doesn’t raise a new legal issue.

In fact, he said in his ruling that the Internet may make the risk of harm associated with hate speech a more pressing issue.

The judge dismissed the constitutional challenge, saying Topham failed to identify any new legal issues under the charter and didn’t present any evidence that would shift the debate about the hate statements being justified.

    Free speech is not alive and well here. And on the West Coast just mention your conservative views or support ot Trump and you will be ostracized just as often as not.

    This is a socialized country with a strong hand on the media. Bnai Brith and other such bastions of freedom have their fingers everywhere. A few years ago when George Galloway was coming to speak in Canada, our PM of the time Harper, took advice from an established terrorist organization, the ADL, as to whether or not to allow him into the country. It was denied the same weekend that Bush spoke in Calgary……

    He actually called upon a ZIONIST TERRORIST group for advice!

    We can only pray that they go easy on Arthur. I don’t know what he plans next but we can only thank him for a fight well fought on behalf of all Canadians, whether they know it or not.

    I am an American, but I used to live in Ontario. Other than French-Canadians and Albertans, Canadians are a conformist and timid lot. They are easily intimidated by a socialist, Zionist, nanny state which forces multiculturalism on the people. Anyone who criticizes multiculturalism or Israel will find themselves out of a job — as most jobs in Canada are government jobs. They will also be labeled as “intolerant” — which is Canadian code for racist. As for free speech, it does not exist as Americans understand it in Canada.
